The Changing Landscape of Post-Grant Proceedings

What was once a near-death sentence for a patent, post-grant proceedings before the Patent Trial and Appeal Board (including inter partes reviews (IPRs) and post-grant reviews (PGRs)) have undergone a major overhaul under the leadership of the current Director of the Patent and Trademark Office, John Squires. This session will examine recent statistics related to post-grant proceedings, the numerous rule changes, and provide practical guidance to practitioners for navigating these proceedings in their current state. The session will also provide some reminders and guidance on ex parte reexamination, which has experienced a resurgence in view of these changes to post-grant proceedings.
