IP Protections for New Plant Varieties: Options and Strategies for Securing and Enforcing Protections

Presented Wednesday, October 8th, 2025

The U.S. has allowed breeders to secure IP protection for their new plant varieties for nearly a century, but options for doing so have changed significantly in recent years.  This session will explore the options that can be used to protect different types of new plant varieties and related innovations in the U.S., including some of the strategy considerations that should go into that decision.  It will also look at enforcement of those rights and some of the recent developments in that area that might further impact the decision on which types of IP rights to use in protecting new plant varieties and innovations.
