The case involves a start-up claiming that it lost a customer because the technology was similar to Hamamatsu. Simmons argued that Hamamatsu gave the start-up notice of the technology it was developing in 2009, and the start-up missed the six-year statute of limitations by the time the lawsuit was filed in 2015.
