Panitch Schwarze is proud to announce the victory for its client, The Regents of the University of California, in a patent licensing dispute brought by PeriRx, Inc. in the Eastern District of Pennsylvania. Due to the efforts of the Panitch team (Philip L. Hirschhorn (lead), Erin M. Dunston, Dennis J. Butler, and Keith A. Jones), PeriRx not only lost on summary judgment and obtained none of the $250 million award that it sought (Summary Judgment Decision), but also was ordered to pay monetary sanctions and had its counsel formally reprimanded by Judge Joshua Wolson (Sanctions Order and Decision). The Regents and Panitch wish that a Motion for Sanctions had not been necessary and hope that Judge Wolson’s Order, sanctions, and reprimands will dissuade such conduct in future disputes. This victory for The Regents affirms the importance of well-written contracts in IP transactions and highlights the value of experienced IP counsel.
