Panitch Schwarze Trademark Counsel Discusses ADR Program with TTAB

Betty MorganPHILADELPHIA (June 2018)Betty Morgan, trademark counsel for intellectual property law firm Panitch Schwarze Belisario & Nadel LLP, recently met with USPTO officials to discuss making an ADR program a permanent part of the proceedings at the Trademark Trial and Appeal Board (TTAB).

An experienced trademark attorney, Morgan serves as chair of the North America Subcommittee of the Alternative Dispute Resolution (ADR) Committee of the International Trademark Association (INTA). Along with INTA representatives Debbie Cohn and Peg Reardon, Morgan met with TTAB representatives, including Chief Judge Gerard F. Rogers and Judge Karen Kuhlke. The discussion focused on making ADR, including mediation and arbitration, a permanent part of TTAB’s proceedings.

The TTAB has encouraged parties to consider using alternative dispute resolution as a means of settling issues brought before it. It also has been requesting feedback from parties that do choose to use arbitration or mediation, in order to assess the value of such approaches in TTAB proceedings.

With deep experience in ADR, Morgan has been a party representative, mediator or arbitrator in more than 100 matters. She serves as a panelist for the American Arbitration Association (AAA) and National Arbitration and Mediation (NAM). She was invited to join the peer-reviewed International Institute for Conflict Prevention and Resolution (CPR) as a mediator where she is a member of the Trademark Panel, Entertainment Panel, Employment Panel and Philadelphia ADR Panel.

She also serves on INTA’s Panel of Mediators and is a neutral with the World Intellectual Property Organization (WIPO). As a FINRA public arbitrator, Morgan is injunction-qualified and has served as a panel chair.
